The above named petitioner no.1 most humbly begs to state at fallows:-
1) That, the petitioners had filed an application under section 125 of Cr.P.C seeking monthly maintenance vide Mise Case No- ... of 2017 from the opposite party before the Ld. ....................... The Ld. ................... by judgement/order date 10/11/2017 and order that the pposite party shall pay Rs.2000/- only to the petitioner Sl. No- 1 and Rs. 1000/- to her minor children Sl. No-2 per month and both the petitioners in total Rs. (2,000+1000/-)=3000/- per month
2) That after the said judgment and order was passed by the Ld. ................. The opposite party has been neglecting to pay monthly maintenance allowance. To The Petitioner till to day.
3) That the petitioner is very poor and she has no source f income.The Petitioner has been passing her days along with minor children with extreme misery and hence the petitioners filed this case for getting of the said amount from the opposite party as per law..
4) That the rest will be orally submitted at the time of hearing.
Hence, it is prayed that your honour may kindly be pleased to consider the prayer and necessary order may be passed and
8) Admite the petition.
9) Issue notice upon the OP to pay the monthly maintenance allowance w.e.f. November 2017 to May 2018 arrear of maintenance of allowance and issued warrant failure to pay of monthly maintenance of arrear of Rs.21,000/- as stated above.
